These Terms of Service ("Terms") govern your access to and use of DevTraq.ai (the "Service"), operated by FIT PropTech, a FIT Solutions company ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.
DevTraq is an AI-powered platform for multifamily real estate development analysis. The Service helps developers, investors, and project teams analyze sites, model pro formas, manage deal pipelines, and coordinate projects. Features include automated site scoring, financial modeling, document management, and an AI assistant.
You must register an account to use the Service. You agree to provide accurate, current information and to keep it updated. You are responsible for maintaining the confidentiality of your sign-in credentials and for all activity under your account. Notify us immediately at admin@fitprotech.ai of any unauthorized use.
New accounts may receive a 30-day free trial of the Service. After the trial, continued use requires a paid subscription. We may modify pricing, features included in any plan, or trial terms at any time, with reasonable advance notice for changes affecting existing paid subscribers.
You agree not to:
You retain ownership of data you upload to the Service ("Your Content"), including deal details, financial inputs, project documents, and historical projects. You grant us a worldwide, non-exclusive license to host, process, and display Your Content solely to provide the Service to you. We will not sell Your Content or use it to train third-party models.
You are responsible for ensuring you have the right to upload and share any content with the Service.
The Service uses artificial intelligence to generate site scores, written analyses, pro forma calculations, deal recommendations, and assistant responses ("AI Outputs"). AI Outputs are produced by models that can be inaccurate, incomplete, or biased.
AI Outputs are decision-support tools, not professional advice. They do not constitute investment, legal, tax, accounting, appraisal, engineering, or real estate brokerage advice. You are solely responsible for independently verifying all AI Outputs and for any decisions you make. Always engage qualified professionals before committing capital, signing contracts, or making investment decisions.
The Service integrates third-party data including property records, zoning information, demographic data, rent estimates, flood-risk data, and mapping. These sources are provided "as is" and may be incomplete, outdated, or inaccurate. We do not warrant the accuracy of any third-party data displayed in the Service.
The Service, including its software, design, AI prompts, scoring methodology, and content (excluding Your Content and third-party data), is owned by FIT PropTech and protected by copyright, trademark, and other laws. We grant you a limited, revocable, non-transferable license to use the Service for its intended purpose during your subscription.
Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI OUTPUTS WILL BE ACCURATE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. IN NO EVENT WILL WE BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, LOST REVENUE, OR LOST DATA, EVEN IF ADVISED OF THE POSSIBILITY.
You agree to indemnify and hold FIT PropTech harmless from claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service, Your Content, or your violation of these Terms.
You may stop using the Service at any time. We may suspend or terminate your account for any reason, including violation of these Terms, with notice where reasonably possible. On termination, your right to access the Service ends. We will retain Your Content for a reasonable period to allow you to export it before deletion, except where retention is required by law.
We may update these Terms from time to time. We will post the updated Terms here and update the "Last Updated" date. Material changes will be communicated by email or in-app notice. Your continued use of the Service after changes take effect constitutes acceptance.
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws principles. Any dispute will be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to that jurisdiction.
